The Payment Chef is an independent payments consulting business serving small businesses and nonprofits. These Terms of Service govern your use of our website and consulting services. By accessing our website or engaging our services, you agree to these terms. If you have questions, contact us at hello@thepaymentchef.com.
The Payment Chef provides independent payments consulting through our First Course, Second Seating, and A La Carte offerings. The scope, deliverables, and timeline for each engagement are outlined at the start of our work together. You agree to use our services for lawful business purposes only. You may not use our website or consulting materials to facilitate illegal transactions, commit fraud, or violate any applicable local, state, or federal laws.
Our recommendations are based on the information you provide during our engagement. While we bring sixteen years of industry experience to every project, we cannot guarantee specific outcomes. Payment processing results depend on many factors outside our control, including provider policies, your business model, and market conditions.
The Payment Chef has no affiliations, partnerships, or commission arrangements with any payment provider. Our recommendations are made solely in your interest. We are not responsible for the products, services, pricing, or performance of any third party provider we recommend.
You agree to provide accurate and complete information during our engagement. We rely on the information you share to build your Chef's Assessment and make tailored recommendations. Incomplete or inaccurate information may affect the quality of our advice. You are responsible for the decisions you make based on our guidance.
We treat all information you share with us as confidential. We will not share your business information with third parties without your consent, except as required by law.
The Payment Chef brand, logo, methodology, and custom deliverables including the Chef's Assessment structure remain our intellectual property. You may use the deliverables we provide for your own internal business purposes, but you may not reproduce, resell, or distribute our proprietary materials or methodologies without our explicit written consent.
Financial terms for each engagement will be agreed upon before work begins. We reserve the right to pause or discontinue work if agreed financial terms are not met.
While we strive to provide accurate and up to date recommendations, the payments industry changes rapidly. We do not guarantee specific financial outcomes or approval by third party processors. The Payment Chef shall not be held liable for any indirect, incidental, or consequential damages resulting from your adoption or rejection of our consulting advice, or from actions taken by third party payment providers. Our liability for any claim arising from our services is limited to the amount you paid for the engagement in question.
You agree to indemnify and hold harmless The Payment Chef from any claims, damages, losses, or expenses arising out of your use of our services, your violation of these Terms of Service, or your infringement of any third party rights.
Any disputes arising out of or related to these Terms of Service or our consulting engagements shall be governed by the laws of the Commonwealth of Massachusetts. We encourage resolving disputes through good faith negotiation before pursuing formal legal action.
We may update these Terms of Service from time to time. The most current version will always be posted on this page with the date of last update. Your continued use of our services after any modifications indicates your acceptance of the updated terms.
If you have questions about these Terms of Service or need to send a formal legal notice, contact us at hello@thepaymentchef.com.
